I think any good moderator will give people who offend the forum rules enough time to work on a better attitude. As long you show the determination of improving your personal conduct, I don't believe you'll be banned. If however you persist then I’m sure you'll bump into Deez or Redemptions "ban button" sooner or later.
As for cataloguing the more strict rules of conduct as being "fascist", know that it is the reaction upon anarchy and chaos of the past weeks. If people had more self-discipline, there would be no need to put on the thumbscrews...
If you behave like children, you shall be treated as such...
As far as your remarks on the quality of forums and the community:
Everything is a fine balance between rules and freedom. Too much freedom with too little rules leads to anarchy, but the opposite is not desirable either as freedom of speech is essential to improve things.
The bottom line is that you should be able to voice your opinions but with respect to others and with the appropriated language.
